1. Eligibility to Use the Services

• You are solely responsible for maintaining the confidentiality of your account credentials (username, password) and for all activities conducted under your account. You agree to notify us immediately at service@wtigg.com if you suspect any unauthorized access to or use of your account.
• We are not liable for any loss or damage arising from your failure to protect your account credentials or monitor your account activity.

3. Product Information & Availability

• We strive to provide accurate and up-to-date information about our jade jewelry products, including descriptions, images, prices, and specifications (e.g., jade type, dimensions, craftsmanship). However, we do not warrant that product information is error-free, complete, or current.
• Product colors may vary slightly from images on the Website due to differences in device displays, lighting, or jade’s natural variations (a characteristic of genuine jade).
• All jade jewelry is labeled as “natural Grade A jade/jadeite” unless otherwise stated, meaning it is 未经人工染色、处理或优化 (untreated, undyed, and unenhanced) in accordance with industry standards.
• Products are subject to availability. We reserve the right to discontinue products, limit quantities, or modify prices at any time without prior notice. If a product you ordered is unavailable, we will notify you promptly and offer a refund or exchange (if applicable).

4. Orders & Payments

4.1 Order Placement & Acceptance

• When you place an order through the Website, you submit a binding offer to purchase the selected products. We reserve the right to accept or reject your order at our sole discretion (e.g., if product information is incorrect, payment is invalid, or the product is out of stock).
• An order is considered confirmed only when we send you an order confirmation email with details of your purchase. This email constitutes our acceptance of your offer.

4.2 Payment Terms

• You agree to pay the full purchase price (including applicable taxes, shipping fees, and insurance) at the time of order placement.
• We accept major credit cards (Visa, Mastercard, American Express, Discover), Apple Pay, and other payment methods indicated on the Website. 4.3 Taxes & Duties

• U.S. orders: Sales tax is applied based on the shipping address and applicable state/local tax laws.
• International orders: You are responsible for paying all customs duties, import taxes, or fees imposed by your country’s customs authorities. These charges are not included in the purchase price or shipping fees, and we have no control over them. Please check with your local customs office for details before placing an order.

5. Shipping & Delivery

• We offer worldwide shipping as outlined on the Website. Shipping times are estimates and may vary due to carrier delays, customs processing (for international orders), or other factors beyond our control.
• We are not liable for delays in delivery or lost/damaged packages once the carrier confirms shipment. For high-value items, we recommend purchasing shipping insurance at checkout (optional for most orders).
• Risk of loss or damage to products passes to you upon delivery by the carrier. You agree to inspect packages upon receipt and notify us within 7 days of delivery of any damage or discrepancies (see Return & Refund Policy for details).

6. Intellectual Property Rights

• All content on the Website, including but not limited to product images, logos, brand names (WTIGG), text, graphics, designs, and software, is the property of WTIGG or our licensors and is protected by U.S. and international intellectual property laws (e.g., copyright, trademark, patent).
• You may not copy, reproduce, distribute, modify, adapt, display, sell, or exploit any content from the Website for commercial or non-commercial purposes without our prior written permission.
• “WTIGG” and our logo are registered trademarks. You may not use these marks or any confusingly similar marks without our explicit consent.

7. User Conduct

• You agree to use the Services only for lawful purposes and in compliance with these Terms and applicable laws. You may not:
  • Engage in fraudulent, deceptive, or illegal activities (e.g., ordering products with stolen payment methods, submitting false return claims).

8. Limitation of Liability

• To the maximum extent permitted by law, WTIGG and its officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, consequential, special, or punitive damages (including but not limited to loss of profits, data, or goodwill) arising from your use of the Services, products, or these Terms.
• Our total liability for any claim arising from or related to the Services or products shall not exceed the total purchase price of the product(s) in question.
• This limitation of liability applies regardless of the legal theory (contract, tort, negligence, strict liability, etc.) and survives even if we have been advised of the possibility of such damages.

9. Disclaimers of Warranties

• The Services and products are provided on an “as is” and “as available” basis. We disclaim all warranties, express or implied, including but not limited to:
  • Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • Warranties that the Website will be error-free, uninterrupted, or secure.
• While we strive to ensure the quality of our jade jewelry, natural jade may contain minor inclusions or variations (e.g., slight color differences, tiny cracks) that are not defects but part of the gemstone’s natural character.

10. Indemnification

• You agree to indemnify, defend, and hold harmless WTIGG and its officers, directors, employees, agents, and licensors from and against any claims, losses, damages, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising from:
  • Your use of the Services or violation of these Terms.

11. Termination

13. Governing Law & Dispute Resolution

• These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of laws principles.
• Any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall first be resolved through good-faith negotiation. If negotiation fails, the dispute shall be submitted to binding arbitration in Flushing, NY, in accordance with the rules of the American Arbitration Association (AAA). Arbitration awards are final and enforceable in any court of competent jurisdiction.
• You waive the right to participate in a class action lawsuit or class-wide arbitration against us.

14. Miscellaneous

• These Terms, together with our Privacy Policy and Return & Refund Policy, constitute the entire agreement between you and WTIGG regarding the Services and supersede all prior or contemporaneous agreements, communications, or understandings (written or oral).
• If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.
• Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any future enforcement.
• You may not assign these Terms without our prior written consent. We may assign these Terms to a third party in connection with a merger, acquisition, or sale of assets.
